GENERAL TERMS AND CONDITIONS

of Icarus Aviation Group s.r.o. for the provision of aviation services
(Valid and effective from January 1, 2026)

I. Introductory Provisions

1.1. Service Provider

These General Terms and Conditions (hereinafter referred to as "GTC") govern the contractual relationship between the business entity:

(hereinafter referred to as the "Provider")

and the natural or legal person (hereinafter referred to as the "Customer" or "Client") who inquires about or utilizes the Provider's services.

1.2. Subject of the GTC

These GTC govern the rights and obligations regarding the provision of services presented on the website stansepilotem.cz, particularly:

  • Flight training and educational courses (PPL, CPL, IFR, etc.).
  • Introductory and proficiency flights ("Pilot for a Day" products, Time Building).
  • Air transport mediation and aircraft rental.
  • Sale of gift vouchers.

1.3. Precedence of Individual Agreement

If a written Training Agreement is concluded between the Provider and the Customer (typically for long-term courses), the provisions of such agreement shall take precedence over these GTC.

II. Inquiry, Order, and Conclusion of Contract

2.1. Informative Nature of the Website

The website presentation of services is a non-binding catalog. Sending a contact form via the website is not considered a binding proposal to enter into a contract, but rather a non-binding inquiry.

2.2. Contract Conclusion Procedure

The contractual relationship is established in one of the following ways:

  1. Approval of Offer: Based on the Customer's inquiry (via e-mail, telephone, or form), the Provider will send a specific price offer or a request for payment (invoice/proforma invoice). The contract is concluded at the moment the Customer demonstrably accepts this offer or pays the relevant amount.
  2. Signing of a Contract: For long-term training, by signing a written Training Agreement.

By paying the invoice or confirming the order, the Customer confirms that they have read these GTC and agree to them.

2.3. Payment Conditions

The price of services is payable in advance by bank transfer to the Provider's account specified on the invoice, unless agreed otherwise (e.g., a training installment plan).

III. Gift Vouchers

3.1. Validity and Redemption

  • Validity: The voucher is valid for 12 months from the date of issue, unless stated otherwise. After this period, the right to use the service expires without compensation.
  • Reservation: The voucher holder is obliged to book a flight date well in advance, no later than 14 days before the voucher expires.

3.2. Transferability

Vouchers are transferable. Any change of holder must be reported when booking a date. The new holder assumes all rights and obligations of the original Customer, including the requirement to meet medical fitness standards.

IV. Operating Conditions and Safety

4.1. Health Status – "Pilot for a Day"

The participant of the "Pilot for a Day" product acknowledges that this is an introductory flight training lesson with active participation. The participant solemnly declares that they do not suffer from serious health problems (e.g., epilepsy, heart defects) and are not under the influence of alcohol or addictive substances.

4.2. Authority of the Pilot-in-Command

The Pilot-in-Command (instructor) is responsible for the safety of the flight. The Customer is obliged to follow their instructions without exception. In the event of failure to follow instructions that jeopardize safety, the Pilot-in-Command is authorized to terminate the flight immediately without entitlement to a refund.

4.3. Meteorological Conditions and Force Majeure

The Provider reserves the right to cancel or reschedule a flight in the event of unfavorable weather, technical failure, or airspace restrictions. In such cases, the Customer is entitled to an alternative date. Financial compensation for travel costs or accommodation is not provided.

V. Cancellation Policy and Rescheduling

If the Customer has already bindingly reserved a specific flight date, the following cancellation policy applies:

  • Cancellation more than 72 hours before the flight: Free of charge (option to reschedule).
  • Cancellation 72 to 24 hours before the flight: Cancellation fee of 50% of the service price.
  • Cancellation less than 24 hours before the flight or no-show: Cancellation fee of 100% (voucher is forfeited).

The cancellation fee may be waived upon presentation of serious medical reasons (medical report).

VI. Liability for Damage

The Provider declares that the aircraft are insured for third-party liability in accordance with Regulation (EC) No. 785/2004.

For training flights (including "Pilot for a Day"), where the participant actively intervenes in the controls, the participant is liable for damages caused intentionally or by gross negligence. We recommend taking out pilot liability insurance.

VII. Withdrawal from the Contract (Consumers)

The consumer has the right to withdraw from a contract concluded by distance (e-mail) within 14 days of receiving the voucher without giving any reason.

Exceptions: The consumer cannot withdraw from the contract if the service has already been fulfilled (the flight took place), or if it concerns a contract for leisure activities (reserved flight date) to be performed on a specific date.

VIII. Personal Data Protection

The Provider processes the Customer's personal data for the purpose of contract fulfillment and legal obligations (maintaining flight documentation according to Civil Aviation Authority requirements). Detailed information on processing is available upon request.

IX. Final Provisions

Any disputes will be resolved preferentially by agreement. The Czech Trade Inspection Authority (www.coi.cz) is the competent body for the out-of-court settlement of consumer disputes.
